MOHRE update - Submissions now required to register staff pay modification arrangements
The new Ministerial Resolution (No. 279 of 2020) released by The Ministry of Human Resources and Emiratisation (MOHRE) Click here for Resolution pdf contains guidance for onshore companies as to employment related measures they can take in response to the global Covid-19 outbreak. The Resolution was effective 26 March 2020.
Part of the measures was to assist companies in mutually agreeing with their staff in taking unpaid leave and also handling temporary or permanent reductions in salary and other modification to employment arrangements.
To date these mutually agreed modifications have been handled by employee letter only with no mechanism to practically submit these modifications to MOHRE. However as from Thursday 30th April MOHRE are now accepting the registration of these changes to employment terms through the MOHRE system using a Temporary Supplementary Annex – click here for ANNEX pdf.
The MOHRE has now also reiterated that employers must ensure they have filed documents indicating consent from both parties of these changes to employment arrangements. See press release below:
We are therefore recommending that all companies ensure that they have submitted the Temporary Supplementary Annex to MOHRE as swiftly as possible, for each staff member that has agreed to modified employment arrangements, so as to prevent any blocks or fine from MOHRE that may be levied in the future - for example if WPS payments are below the required monthly threshold.
