Abu Dhabi Work Visa Guide for Companies
As the capital of the UAE and the largest of the seven emirates, Abu Dhabi attracts professionals and enterprises from across the world. However, when setting up a company in Abu Dhabi, companies looking to employ expatriates must secure the appropriate work visas to remain compliant and operate smoothly.
This guide provides a comprehensive overview of the work visa types available in Abu Dhabi, step-by-step procedures for application, required documentation, and essential considerations for effectively managing the visa process.
Overview of Work Visas in Abu Dhabi
In Abu Dhabi, the standard employer-sponsored work visa remains the primary choice for most companies. It allows employees to work and reside in the UAE for two years, with the option for renewal. However, there are additional options such as the Golden visa which offers ten-year residency respectively, typically available for specialised professionals earning over AED30K monthly salary and other high-value contributors. There is also the remote work visas which cater to digital nomads, working in Dubai from an overseas-based company.
The UAE also launched the 5-year green visa, which offers freelancers and companies the ability to secure 5 years for their employees. As we come to the end of 2024, the Green Visa is still not live to obtain through immigration portals in Abu Dhabi or the UAE.
It's important to understand the options available and for you to select the appropriate visa type for your staffing needs, whether for standard employment, contract-based work, or specialised talent acquisition.
Eligibility Criteria for Work Visas in Abu Dhabi
To qualify for a work visa, both the employer and the employee must meet specific conditions set by the Ministry of Human Resources and Emiratisation (MoHRE). Employees must be aged 18 or older, while employers need a valid operating license and a clean compliance record. The role an employee is hired for should also align with the company’s registered business activities.
There is no maximum age limit for work; however, hiring employees over the age of 65 incurs additional fees every two years. Additionally, employees must possess at least a high school diploma.
Required Documents for Work Visa Applications
Employers must collect and submit the following documents:
- Original passport with a copy (minimum six months validity)
- Passport-sized photos meeting UAE specifications
- Signed employment contract
- Medical certificate from an approved UAE health centre
- Emirates ID application form
- Proof of health insurance coverage
- Relevant company documentation, such as the commercial licence and company card
Work Visa application process in Abu Dhabi
Secure an Employment Entry Permit
- Quota Approval: Employers need to obtain entry visa quota approval, particularly in free zones, to comply with regulations regarding staff numbers.
- Submit Employment Contract: The employer provides a signed employment contract for MoHRE approval in multiple languages (English, Arabic, and the employee’s native language).
- Submit Work Visa Application: The application is submitted with supporting documents for review. The MoHRE verifies company registration and assesses the availability of qualified UAE nationals for the role before proceeding.
- Receive Entry Permit: Once approved, an entry permit valid for 60 days is issued, allowing the employee to enter the UAE.
- Biometric Registration: The employee visits an Emirates Identity Authority (EIDA) centre to submit biometric data, including fingerprints and a photo. This step is required for both the medical check and later visa processing.
Finalise the Work Visa and Residence Visa
- Medical Examination: The employee completes a medical screening at an approved clinic. The results are essential for processing the residence visa.
- Upload the Labour Contract: The employer must upload the signed contract to the MoHRE system within 14 days of the medical clearance.
- Submit Health Insurance Proof: Health insurance coverage must be provided and documented.
- Issuance of Work Visa: The MoHRE issues the work visa, which allows the employee to commence work. This step typically takes about five days.
- Apply for Residence Visa: The employer submits the final residence visa application. If the Emirates ID is not yet issued, the application receipt will suffice temporarily. The residence visa then enables employees to access essential services such as banking and vehicle registration.
Transitioning from Visit Visa to Work Visa
For those already in Abu Dhabi on a visit visa, employers can transition them to a work visa by initiating a change of status. You can begin the work permit application by obtaining the signed employment contract with the employee, assisting the employee in completing required medical checks and biometric registration and finally request a ‘change of status’ to convert the visit visa to a work visa, allowing the employee to stay without leaving the UAE. This process typically takes around five days.
Renewing Work Visas in Abu Dhabi
Work visas in Abu Dhabi are generally valid for one to three years. It is advisable to start the renewal process at least 30 days before the visa expires to avoid penalties. The renewal process follows similar steps as the initial application.
Costs Associated with Work Visas in Abu Dhabi
The cost of a work visa depends on the skill level of the job and the age of the employee. Initial approval fees are approximately AED 200, while issuance fees depend on the category skill level. Skill categories are defined from category 1 to 3.
Category 1 refers to CEOs, General Managers, and Directors and is the highest skill level. The issuance fee for Category 1 employees will be less than those of Categories 2, 3, and employees over the age of 65. So, the skill level of employees will affect the cost to obtain the employee's visa. The more skilled, the less cost on the company.
